The United States Environmental
Protection Agency has established a national goal of
cleaning up between 18,000 and 23,000 underground
storage tank contamination sites each year between 2003
and 2007. Pennsylvania, West Virginia, and Ohio alone
represent over 10,500 backlogged sites requiring
attention. This does not include corporations seeking
new installations, upgrades, or concerned with
assessments aimed at preventative action.

PA Underground Storage Tank Indemnification Fund (USTIF)
Both the EPA and the PA Department of Environmental
Protection provide for the regulation of the
construction, upgrade, and operation of underground
storage tanks. Along with these regulations come
insurance requirements in the event of an
underground storage tank leak. |

The Pennsylvania Underground Storage Tank Indemnification Fund
was established to help owners and operators in
meeting the insurance requirements. The USTIF makes
claim payments to eligible UST owners or operators
for damages caused by a release from their
underground storage tanks. To be eligible, the
release must have occurred on or after February 1,
1994.

The USTIF covers:
-
Reasonable and necessary costs
for corrective actions to clean up contamination
from leaking tanks.
-
Claims for bodily injury and
property damage that occur as a result of the
leak.
-
Identifying the extent,
nature, and impact of the release and developing
a remedial action plan for restoring the site.
The USTIF does not cover any
upgrade costs for the facility or any repair and
maintenance work performed on the USTs, including
tank removal. |

Claim payments are limited to the actual costs of
corrective action and third party liability, but
cannot exceed an annual aggregate of $1.5 million
for each owner and operator. There is a $5,000
deductible per tank.

handled numerous reimbursement projects from
notification and application to assessment and
remediation goals.
